This Privacy Policy describes how The Ricard Group, LLC ("TRG," "we," "us," or "our") collects, uses, and shares information when you use TRG Distribution at distribution.thericardgroup.com ("the Platform").

Section 1
Information We Collect
Information You Provide
  • Account information: Name and email address, collected when you create an account through Clerk (our authentication provider).
  • Submission information: Film title, description, category, producer name, asset links, subtitle files, and other metadata you provide when submitting a film.
  • Contact information: Any information you provide when contacting us through our contact form or by email.
Information Collected Automatically
  • Usage data: Pages visited, time on page, browser type, device type, and IP address — collected by Cloudflare as part of standard web hosting.
  • Cookies and similar technologies: Cloudflare sets functional cookies as part of CDN delivery and security operations (e.g., bot detection, session continuity). Clerk may set cookies or tokens to maintain your authenticated session. We do not use cookies for advertising or cross-site tracking.
  • Authentication events: Sign-in activity, including timestamps and device information, collected by Clerk.
Information Collected Through Transactions
  • Payment information: Billing details processed by Stripe. TRG does not store or access your full card number, CVV, or bank account details. Stripe handles all payment processing and maintains its own privacy policy.
  • Subscription status: Plan type, renewal dates, and billing history — accessible to TRG through the Stripe API to manage your account.
Information Generated by the Platform
  • Earnings records: Revenue received from platforms on your behalf, your calculated share, and payout history — stored in TRG's database.
  • Pipeline activity: Stage changes, admin notes, delivery timestamps, and platform delivery status for your submissions — stored in TRG's database.

How We Use Your Information

We use the information we collect to:

  • Create and manage your account
  • Process film submissions and manage your submissions through the review pipeline
  • Deliver your film to distribution platforms you have approved
  • Calculate and pay out your earnings
  • Send transactional emails — submission confirmations, stage update notifications, billing receipts, and account-related communications
  • Respond to support requests and questions you send us directly
  • Maintain the security and integrity of the Platform

We do not sell your personal information. We do not use your information for advertising targeting.

Third-Party Services

TRG uses the following third-party service providers to operate the Platform. Each processes data on our behalf under their respective privacy policies.

We do not share your personal information with any other third party except as required by law or as necessary to operate the services listed above.

Section 4
Film Assets and Content

When you submit a film, the asset files and metadata you provide are stored on TRG's infrastructure (Cloudflare storage) and may be uploaded to distribution platforms you have approved as part of our delivery services.

We do not claim ownership of your content. We hold a limited, non-exclusive license to store, transcode, and deliver your content as described in our Terms and Conditions. That license ends when your agreement with TRG ends.

Data Retention

We retain your information for as long as your account is active and for a reasonable period thereafter to comply with legal obligations, resolve disputes, and fulfill contractual commitments.

  • Account data: Retained while your account is active. Deleted within 90 days of a verified account deletion request, subject to any legal hold obligations.
  • Earnings and financial records: Retained for seven (7) years from the date of the transaction, consistent with standard financial recordkeeping requirements.
  • Submission records: Retained for the duration of the distribution agreement and for two (2) years following termination, to support any disputes or platform inquiries.

Your Rights

Depending on where you are located, you may have rights regarding your personal information, including:

  • Access: Request a copy of the personal information we hold about you.
  • Correction: Request correction of inaccurate personal information.
  • Deletion: Request deletion of your personal information, subject to retention requirements described above.
  • Data portability: Request your earnings history, submission records, and account data in a portable format.
  • Objection or restriction: Object to or request restriction of certain processing activities.
Texas residents: TRG complies with the Texas Data Privacy and Security Act (TDPSA), effective July 1, 2024. Texas residents have the right to access, correct, delete, and obtain a copy of personal data, and to opt out of the sale of personal data (we do not sell personal data) and opt out of processing personal data for targeted advertising (we do not use personal data for targeted advertising). California residents: California residents have rights under the California Privacy Rights Act (CPRA), including the right to know what personal information we collect, the right to delete, the right to correct, and the right to opt out of the sale or sharing of personal information for cross-context behavioral advertising. We do not sell personal information and do not share personal information for cross-context behavioral advertising. To exercise your rights, contact us at the address below.

To exercise any of these rights, contact us at info@thericardgroup.com with the subject line "Privacy Request." We will respond within 45 days of receiving a verified request. If we require additional time to respond due to the complexity or volume of requests, we will notify you within the initial 45-day period and may extend our response time by an additional 45 days.

Appeal process: If we deny or are unable to fulfill your privacy rights request, you may appeal our decision by sending a written appeal to info@thericardgroup.com with the subject line "Privacy Appeal." We will respond to your appeal within 60 days. If your appeal is denied, you may submit a complaint to the Texas Attorney General (for Texas residents) or the California Privacy Protection Agency (for California residents).

Section 7
Security

We implement industry-standard security measures to protect your information, including encrypted transmission (HTTPS), access controls on all systems that process personal data, and authentication security through Clerk. No method of transmission or storage is 100% secure.

Data breach notification: If we discover a security incident that results in unauthorized access to or disclosure of your personal information, we will notify you by email to the address associated with your account within a reasonable time after confirming the breach, consistent with applicable law. We will describe the nature of the incident, the information involved, and steps you can take to protect yourself. If you have reason to believe your information has been compromised, contact us immediately at info@thericardgroup.com.

Section 8
Children's Privacy

TRG Distribution is not directed to children under 18. We do not knowingly collect personal information from anyone under 18. If we become aware that we have collected personal information from a minor, we will delete it promptly.

Section 9
Changes to This Policy

We may update this Privacy Policy from time to time. Material changes — including changes to the categories of information we collect, how we use it, who we share it with, or your rights under this Policy — will be communicated to you by email or by a notice in your dashboard at least 30 days before the change takes effect. Non-material changes (such as typographical corrections or clarifications that do not affect your rights) may be made at any time without notice; the "last updated" date will reflect the change. The updated policy will be posted at this URL with a revised effective date. Continued use of the Platform after the effective date of a material change constitutes acceptance of the updated Policy.
